 General Terms and Conditions (GTC)

1. Scope

These Terms and Conditions apply to the use of the training facility operated by bSport Group GmbH (hereinafter referred to as “Zurich Nord CrossFit”).

2. Membership

Membership is personal and non-transferable.

3. Terms and Conditions and Operating Rules (“Box Rules”)

The member agrees to comply with the Terms and Conditions and the facility rules (“Box Rules”) and to follow the instructions of the staff and coaches.

4. Payment

The membership fee is due upon signing the contract or renewing it. If any invoices remain unpaid, participation in classes and use of the Open Gym will be prohibited. Payment can be made by card, in cash, by bank transfer, or via standing order.

Memberships that are paid in installments are settled exclusively through “Autopay.”

Payment via “Autopay” involves an automatic monthly charge to the credit card on file in the booking app.

5. Liability

5.1. Use of the facilities and equipment at Zurich Nord CrossFit is at the member’s own risk. Zurich Nord CrossFit and its staff and coaches assume no liability whatsoever for damages resulting from an accident, injury, or illness. It is the member’s responsibility to obtain insurance.

5.2. Zurich Nord CrossFit is not liable for the loss of personal effects, valuables, money, clothing, etc. It is the member’s responsibility to obtain insurance.

6. Hours of Operation

6.1. The Zurich Nord CrossFit training facilities are open during operating hours, except on holidays and during maintenance, cleaning, remodeling, renovation, events, etc.

6.2. The offerings and operating hours are subject to change at any time.

6.3. Closures necessitated by operational requirements and/or changes to services or operating hours do not entitle members to a refund or an extension of their membership.

7. Use and Hold

7.1. Failure to use the Zurich Nord CrossFit facility or to participate in events does not entitle the member to a reduction or refund of the membership fee.

7.2. If there is a valid reason, memberships may be suspended (“on hold”) for a period of at least 2 weeks and no more than 6 months. The request to place the membership on hold must be submitted prior to the absence, along with appropriate documentation (doctor’s note, etc.). A retroactive hold is only possible in the event of illness or accident. The request must be submitted within the first month after the medically certified inability to train has ceased. Requests submitted at a later date cannot be considered. A hold is granted in the event of a work-related stay abroad, illness, accident, pregnancy, or military or civilian service.

7.3. For vacations lasting at least 2 weeks and up to a maximum of 6 months, subscribers with the plans listed below may place their subscription on hold during the contract period by presenting their travel documents. The vacation hold must be requested before the start of the absence.

  •   6-month subscription: 1 hold

  • 12-month subscription: 2 holds

  • 10-ride pass, 1-month subscription, 3-month subscription: cannot be put on hold

7.4. For Kickstart Bootcamps, holds are permitted for a cumulative period of one week to a maximum of two weeks. The missed training time must be made up immediately following the Kickstart Bootcamp. To request a hold, you must submit appropriate documentation of your absence (doctor’s note, travel documents, etc.).

8. Class Reservations, Cancellations, and “No-Shows”

8.1. Classes must be reserved in advance and checked in on-site using a tablet.

8.2. Visitors to Open Gym must check in on-site using the tablet.

8.3. You must attend classes you have reserved and Open Gym sessions. If you are unable to attend a class despite having made a reservation, you must cancel the reservation yourself via Zen Planner at least 2 hours before the class begins.

8.4.   Kurzfristige Stornierungen (<2 Stunden vor Beginn) sind nicht möglich.

8.5. If a reservation is not canceled and the member does not attend the class or Open Gym session, this is considered a “no-show.”

8.6. No-shows will be deducted from class passes or weekly reservation limits.

8.7. Repeated no-shows are considered a violation of the Terms and Conditions and gym rules and may result in a warning or a ban from the facility. There is no entitlement to a refund of the membership fee.

9. Personal Training (“PT”)

9.1. A PT session lasts 55 minutes, 40 minutes, or 25 minutes.

9.2. Payment (for individual PT sessions, PT packages, or monthly installments) must be made prior to each PT session.

9.3. A PT session may be canceled free of charge up to 24 hours in advance if you are unable to attend. For cancellations made within 24 hours or in the event of a no-show, the PT session is considered to have taken place, and no refund or rescheduling is possible. Exceptions are illness or accident supported by a doctor’s note. Services not utilized do not entitle the client to a reduction in payments due, a refund of payments already made, or a waiver of the payment obligation.

10. Violations

Serious or repeated violations of the Terms and Conditions, the facility rules (“Box Rules”), or the instructions of staff or coaches may result in a ban from the facility. There is no entitlement to a refund of the membership fee.

11. Contract Term , Automatic Renewal, and Termination of the Contract

11.1. The term of the contract is specified in the contract and takes effect upon the contract’s conclusion.

11.2. All subscriptions, except for KickStart Bootcamp memberships, are automatically renewed upon expiration unless canceled in writing via email before the expiration date. Class passes are not automatically renewed.

11.3. Withdrawal from the contract during the contract term and corresponding refunds may only be granted in cases of hardship, such as prolonged illness or accident, with appropriate proof; however, there is no entitlement to such refunds. A written request for a refund must be submitted along with the necessary supporting documentation, such as a doctor’s note, etc. In addition, a fee of CHF 60 will be charged to cover administrative costs. No refunds are granted for 1-month subscriptions or class passes.

12. Photos and Videos

12.1. Photos and/or videos may be taken while using the facilities and equipment at Zurich Nord CrossFit.

12.2. Members grant Zurich Nord CrossFit all rights arising from their participation (copyright, neighboring rights, and other rights) without any restrictions in terms of time, location, or content. If this is not desired, the customer is required to expressly notify the staff of this before the class or before visiting the facility. In this case, we will ensure that he or she does not appear in any images.

13. Changes to the Terms and Conditions and Operating Rules (“Box Rules”)

The member expressly acknowledges that the General Terms and Conditions and the Rules of Operation (“Box Rules”) are subject to change and that the member will be notified of such changes in an appropriate manner. The member may not derive any rights from a change to the General Terms and Conditions or the Rules of Operation (“Box Rules”).

14. Governing Law and Jurisdiction

Swiss law applies. The place of jurisdiction is Zurich.
